Terms and Conditions of the Online Store taniekosmetyki.co.uk

These Terms and Conditions define the rules for concluding distance sales contracts via the Online Store, the performance of such contracts, the rights and obligations of the parties, and the complaint procedure. They comply with the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 and the Electronic Commerce (EC Directive) Regulations 2002.

§ 1. Definitions

Regulations – these Terms and Conditions, which define the rules for concluding and performing distance sales agreements through the Online Store, the rights and obligations of the parties, and the complaint procedure.

Customer – a natural person with full legal capacity, a legal person or an organisational unit with legal capacity, who enters into a Distance Sales Agreement with the Seller.

Consumer – a natural person acting for purposes outside their trade, business or profession.

Sole Trader Consumer – a natural person concluding a Distance Sales Agreement directly related to their business activity, where it is clear that the agreement is not of a professional nature for that person.

Trader – a natural or legal person acting for purposes relating to their trade, business or profession.

Online Store – the website operated by the Seller, available at https://taniekosmetyki.co.uk, through which the Customer may obtain information about Goods and their availability, purchase Goods or order services.

Distance Sales Agreement – an agreement for the sale of Goods or the provision of Digital Content or Digital Services concluded through the Online Store.

Goods – movable items available for purchase in the Online Store.

Digital Service – a service enabling the Customer to produce, process, store or access data in digital form, or to share such data.

Digital Content – data produced and supplied in digital form.

Privacy and Cookies Policy – document available at https://taniekosmetyki.co.uk/eng-privacy-and-cookie-notice.html which sets out detailed rules for processing personal data and the use of cookies.

Durable Medium – any tool or medium which enables the Customer or the Seller to store information for future reference for a period adequate to its purpose.

Electronic Order Form – an electronic order procedure provided by the Seller to the Customer.

Electronic Return Form – the electronic procedure provided by the Seller for returns; available at https://taniekosmetyki.co.uk/returns-open.php.

Electronic Complaint Form – the electronic procedure provided by the Seller for complaints; available at https://taniekosmetyki.co.uk/rma-open.php.

Sending an Order – validation of an order by clicking the “Order and Pay” button, treated as submission of a binding declaration of intent to conclude a Distance Sales Agreement with the Seller.

Account – a set of data stored in the Online Store relating to a given Customer and their orders.

Opinion – a subjective rating or comment (1–5 stars) provided by the Customer about the order or Goods.

Subscription Order – an order automatically created as part of a Subscription.

Subscription – an electronic service allowing automatic repeat orders for specific Goods at defined intervals until cancelled by the Customer.

Recurring Payments – automatic payments processed by the payment operator on the basis of the Customer’s prior consent.

Operator – IdoPayments sp. z o.o., al. Piastów 30, 71-064 Szczecin, Poland, entered into the National Court Register no. 0000859711, NIP: 8522666251, REGON: 387039893, share capital: PLN 800,000, providing payment services for the Store.

Payment Card – a card issued under Visa or Mastercard schemes.

Quick Shopping Methods – purchases made using Google Pay, Apple Pay or Express Checkout.

Sales Document – invoice, receipt or electronic proof of purchase delivered to the Customer’s e-mail address.

§ 2. General Provisions

The Online Store provides the following electronic services:

• conclusion of sales contracts via the Online Store,
• registration and use of an Account,
• adding opinions, comments and ratings,
• sending e-mails confirming receipt and acceptance of orders and payments.

Technical requirements: updated web browser (Chrome, Firefox, Edge), Internet access, PDF reader.

Product descriptions and prices on the Online Store are an invitation to treat under UK law, not an offer.

The Seller ensures appropriate technical and organisational measures to secure communication and data exchange via the Online Store.

§ 3. Orders

Orders may be placed via an Account or without registration. In both cases, data necessary to fulfil the order is stored.

Orders are placed by completing the Electronic Order Form or using quick shopping methods. The Customer selects Goods by adding them to the basket. The summary includes: Seller’s details, ordered Goods, prices, delivery costs, payment method, delivery method and estimated delivery time.

By pressing the “Order and Pay” button the Customer declares intent to conclude a Distance Sales Agreement. The Agreement is deemed concluded when the Seller confirms acceptance of the order electronically.

The Customer then receives confirmation by e-mail with all key details of the contract, the Terms and Conditions, and instructions on the right of withdrawal.

Orders are processed within 1–10 working days unless otherwise stated.

§ 4. Payment

Payment methods available are listed at https://taniekosmetyki.co.uk/eng-payments.html. Payments are made in advance unless agreed otherwise. The Seller issues a Sales Document for each purchase.

§ 5. Delivery

Delivery methods are listed at https://taniekosmetyki.co.uk/eng-delivery.html. If Goods are returned due to non-collection by the Customer, the Seller may cancel the contract and refund the payment.

§ 6. Right of Withdrawal

Under the Consumer Contracts Regulations 2013, Consumers have the right to withdraw from a Distance Sales Agreement within 14 days without giving any reason. The withdrawal period expires 14 days after:

• the day the Customer acquires physical possession of the Goods, or
• for multiple Goods delivered separately – the day of receipt of the last item,
• for regular delivery – the day of receipt of the first item,
• for Digital Content not supplied on a tangible medium – the day of contract conclusion.

To exercise this right, the Customer must inform the Seller (STELLAR PRO LTD, 112 High Street, Hounslow, Middlesex, England, TW3 1NA, e-mail: shop@taniekosmetyki.co.uk) of the decision to withdraw by an unequivocal statement (e.g. by e-mail or letter). The Customer may also use the Electronic Return Form.

§ 7. Effects of Withdrawal

The Seller refunds all payments received from the Customer, including standard delivery costs, within 14 days from the day the Seller is informed of withdrawal. Refunds are made using the same payment method unless otherwise agreed. The Seller may withhold reimbursement until the Goods are returned or proof of return is provided.

The Customer must return Goods without undue delay, no later than 14 days after withdrawal, to the Seller’s registered address. The Customer bears the direct cost of return. The Customer is liable for diminished value resulting from handling the Goods beyond what is necessary to establish their nature and characteristics.

§ 8. Complaints

Complaints may be submitted via the Electronic Complaint Form, by e-mail to shop@taniekosmetyki.co.uk or in writing to the Seller’s registered address.

The Customer should describe the defect and provide proof of purchase. The Seller responds within 14 days. If no response is given within this time, the complaint is deemed accepted.

If justified, the Seller bears the cost of repair, replacement and return shipping. The Seller is responsible for conformity of Goods under the Consumer Rights Act 2015.

§ 9. Opinions

Customers may leave ratings (1–5 stars) and comments. Opinions are verified via the e-mail used for purchase. Verified opinions are marked accordingly. The Seller does not edit content but may remove unlawful or offensive content.

§ 10. Intellectual Property

By submitting content (opinions, comments) that qualify as works under copyright law, the Customer grants the Seller a non-exclusive, free licence to use such works for publication online.

§ 11. Subscription

The Seller may offer a Subscription service enabling automatic repeat orders at chosen intervals. Payment is made via Recurring Payments. The Customer may cancel the Subscription at any time. Failure to collect payment results in cancellation of the Subscription Order.

§ 12. Final Provisions

These Terms are effective as of 10 May 2024. UK law applies. Disputes shall be resolved by competent UK courts. Consumers may use Alternative Dispute Resolution (ADR). Information on ADR can be found at: https://www.tradingstandards.uk.

§ 13. Annex 1 – Information on the Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires after 14 days depending on the type of contract (delivery of goods, multiple goods, instalments, or digital content).

You may use the model withdrawal form (Annex 2), or the Electronic Return Form. We will confirm receipt of your withdrawal on a durable medium.

If you withdraw, we will refund all payments received from you, including delivery costs (except additional costs resulting from your choice of a non-standard delivery option), within 14 days. Refunds will be made using the same payment method unless agreed otherwise. We may withhold the refund until we have received the Goods or you provide proof of return.

You must send back the Goods to: STELLAR PRO LTD, 112 High Street, Hounslow, Middlesex, England, TW3 1NA, immediately and in any event not later than 14 days from withdrawal. You will bear the direct cost of returning the Goods.
